The State Law Behind Every Pool Fence

Florida's Residential Swimming Pool Safety Act (Chapter 515, Florida Statutes) applies the same way in Ocala, Belleview, Dunnellon and unincorporated Marion County. Section 515.29 sets out what a pool barrier must do:

  • Stand at least 4 ft high, measured on the outside
  • Have no gaps, openings, indentations or protrusions a young child could use to crawl under, squeeze through or climb over
  • Sit far enough from the water's edge that a child who gets through can't fall straight into the pool
  • Not be placed where a permanent structure or equipment could be used to climb it

Gate Rules

Access gates have to open outward, away from the pool, and be self-closing with a self-latching locking device. The release goes on the pool side of the gate, placed so a small child can't reach it over the top or through a gap. We test every gate from several open positions before inspection.

Permits and Inspection Around Ocala

Pool barriers are permitted and inspected whether your home is inside Ocala city limits or in the county. When the fence is going in with a new pool, the barrier is usually part of the pool project, so we coordinate timing with your pool builder so the final inspection isn't held up. In the city, inspections requested before 4 p.m. are generally serviced the next business day.

Choosing a Pool Fence Material

  • Aluminum: the most common choice. Rust-free, see-through and easy to build to code.
  • Vinyl: privacy around the pool, built without outside footholds.
  • Chain link: only with mesh small enough to meet the barrier rules.

Common Reasons Pool Fences Fail

  • A gap under the fence where the ground dips or washes out after a summer storm
  • A gate that drifts shut but doesn't latch
  • A latch mounted too low on the outside
  • A planter, AC unit or pool equipment pad placed where a child could climb

Pool Fences on Larger Ocala Lots

On acreage and horse properties, the pool is often a long way from the property line, so a dedicated barrier around the pool deck usually makes more sense than relying on a perimeter fence. A 4 to 5 ft aluminum enclosure with one or two gates keeps the pool secure while horses, dogs and kids move freely around the rest of the property.

Every pool gate we build is self-closing and self-latching. See gates for hardware options.

Frequently Asked Questions

How tall does a pool fence have to be in Florida?

At least 4 ft on the outside under F.S. 515.29. Many owners choose 5 ft.

Which way does a pool gate swing?

Outward, away from the pool. It must also close and latch on its own.

Can my backyard privacy fence be the pool barrier?

Sometimes, if it fully meets the barrier rules and any house doors opening to the pool area meet the state's other safety options. We check your layout at the estimate.

Do I need a permit for a pool fence in Ocala?

Yes. Pool barriers are permitted and inspected in both the City of Ocala and Marion County, and we handle both.

Does an above-ground pool need a barrier?

Under F.S. 515.29, the wall of an above-ground pool can serve as its barrier, or a barrier can be mounted on top of it, as long as it meets every barrier requirement. The ladder or steps must lock, be removable, or be fenced in themselves. We check your setup before recommending a fence.

Can you fix an old pool fence so it passes?

Often, by adjusting or replacing hinges and latches and closing gaps. If it's too far gone, see fence replacement.
